Biden Signals Plans To Impose Term Limits On Supreme Court Justices

President Joe Biden is reportedly finalizing plans to support significant changes to the U.S. Supreme Court, including the establishment of term limits for justices and the implementation of an enforceable ethics code. Sources briefed on the matter informed the Washington Post that Biden is also considering a call for a constitutional amendment to remove immunity for presidents and other office holders.

These proposed changes come after the Supreme Court’s recent decision on presidential immunity, which ruled in favor of granting immunity to former President Donald Trump for official acts. The ruling has spurred Biden to seek reforms aimed at ensuring accountability and upholding the rule of law.

In a Zoom call with the Congressional Progressive Caucus on Saturday, Biden discussed his intentions. “I’m going to need your help on the Supreme Court, because I’m about to come out — I don’t want to prematurely announce it — but I’m about to come out with a major initiative on limiting the court … I’ve been working with constitutional scholars for the last three months, and I need some help,” Biden said, according to a transcript obtained by the outlet.

The U.S. Constitution, under Article III, states that justices “shall hold their Offices during good Behaviour,” meaning they serve for life unless impeached. Any changes to this would require significant legislative action, as Congress is the body responsible for making changes to the composition of the Court.

Following the Supreme Court’s decision on Trump’s immunity, Biden addressed the nation, stating, “No one is above the law, not even the President of the United States. With today’s Supreme Court decision on presidential immunity, that fundamentally changed.” He criticized the ruling for undermining the rule of law and highlighted it as part of a broader attack on long-established legal principles.

Biden’s move to propose changes to the Supreme Court comes amid growing calls for him to drop out of the presidential race following a poor debate performance in June. Despite the pressure, Biden appears determined to pursue these judicial reforms.
