Trump’s Legal Team Seeks Disqualification Of DA Fani Willis; Hearing Set for December 5

The Georgia Court of Appeals will hear arguments on December 5 to determine whether Fulton County District Attorney Fani Willis should be disqualified from the election-related case against President Donald Trump. This decision follows the court’s agreement in May to review an earlier ruling by Fulton County Superior Court Judge Scott McAfee, which permitted Willis to stay on the case.

Trump’s legal team argues that Willis should be removed due to her alleged personal relationship with special prosecutor Nathan Wade. In March, Judge McAfee ruled that either Wade or Willis had to leave the case, leading to Wade’s withdrawal shortly afterward. The Georgia Appeals Court has since agreed to halt proceedings in the case while it reviews this ruling, with a final decision expected by March 2025.

Trump is charged with ten counts related to his actions after the 2020 election. Attention has shifted from the charges to allegations regarding Willis and Wade’s relationship and claims that Willis received financial benefits from it. Michael Roman, a co-defendant, has alleged that Wade and Willis’s relationship started before Wade was appointed to the Trump case. Trump’s legal team has supported Roman’s motion to dismiss the charges, arguing that the prosecution is invalid due to this relationship.

Additionally, a recent Supreme Court ruling on presidential immunity could affect the prosecution. Judge McAfee is anticipated to conduct a review to see if the charges meet the criteria set by the Supreme Court.

As the December 5 hearing approaches, the case remains on hold, pending the appeals court’s decision. The outcome of this hearing could significantly impact the future of the legal proceedings against Trump.
